Event overview
This webinar provides social care providers with a practical overview of the Supreme Court’s landmark decision to overrule the long-established Cheshire West framework that has shaped DoLS practice for over a decade. Attendees will understand the new multifactorial approach for assessing deprivations of liberty following the removal of the acid test. Attendees will obtain practical guidance which builds upon interim guidance issued by the CQC and the Department of Health and Social Care, and equips them to;
- upskill their staff and organisations around the key changes to the assessment framework
- recognise what now constitutes a deprivation of liberty requiring authorisation
- manage and review their existing authorisations
- review their current care plans procedures and policies to reflect legal changes
- improve their mental capacity assessment and best interests’ documentation
- reinforce their existing knowledge of their ongoing duties under the Mental Capacity Act, and Health and Social Care Act Regulations and
- prepare Good evidence for CQC around compliance
