What Emma can do for you
Emma is an Associate in the healthcare litigation team. She joined Hempsons in 2016 from a Claimant background.
Emma acts on behalf of NHS Trusts and GPs on a wide range of medical issues including spinal injuries, birth injuries, amputations, and fatal claims as well as cases relating to a delay in diagnosis and/or treatment. She has represented her clients at numerous successful mediations.
Emma recently spent five months on secondment at NHS Resolution assisting the team and gaining valuable insight from her client’s perspective. She is also an active member of the Leeds and District Medico-Legal Committee arranging training and lectures for local lawyers and medics.

On 1 April 2019 NHS Resolution began operating a new state indemnity scheme for general practice. This article seeks to outline the Scheme including an overview of the claims process, what is covered and when to contact NHS Resolution to report in potential clinical negligence claims. It also explains the support that will be provided to you if you are named as Defendant in a claim.
On 9 October 2020 the Court of Appeal handed down Judgment in Swift v Carpenter  EWCA Civ 1295. This article sets out the decision in Swift and considers where we are now.
On 1 April 2020 the Supreme Court handed down two Judgments in Barclays Bank Plc v Various Claimants  UKSC 13 and WM Morrisons Supermarkets Plc v Various Claimants  UKSC 12 in which the Court appears to be moving against vicarious liability.
