Tim Dennis

Tim joined Hempsons in May and is a partner specialising in commercial disputes, particularly those involving procurement related issues. He is regularly instructed to work with the wider procurement team to provide pre-emptive and proactive advice in order that the risk of a challenge being pursued is minimised. 

Tim has acted in several leading procurement cases in recent years, and regularly advises both contracting authorities (including NHS trusts, central NHS bodies, clinical commissioning groups and local authorities) and economic operators in relation to challenges following alleged breaches of the relevant regulations. Recent high value/high profile challenges have included: successfully representing a local authority in lifting an automatic suspension following a challenge to the procurement of ANPR cameras as part of a scheme to establish one of the UK’s first Clean Air Zones; successfully representing a number of CCGs in opposing an application for expedition to trial (this case involving a number of issues arising from the Covid-19 pandemic); representing a large NHS client (and successfully avoiding proceedings being issued against it) in a construction related procurement dispute; successfully representing an economic operator in relation to a dispute regarding contracts awarded under multi-million pound framework agreement, the case settling on very favourable terms; and successfully obtaining an order for strike out on behalf of a defendant client on the grounds of limitation. He has been recognised in the Legal 500 for this specialism.

Tim regularly provides training to clients on procurement litigation case law and strategy. He also regularly advises clients, both in the public and private sector, in respect of commercial and contractual disputes. His recent work includes representing an NHS trust in a large value dispute relating to the provision of defective scanning equipment (the case settling on favourable terms at mediation); acting in a multi-million pound dispute relating to alleged fire defects at a hospital (ongoing); providing risk advice to a public sector client in relation to a circa £19 million contractual dispute; and advising a commercial client in a multi-million pound breach of confidence claim (that case settling on favourable terms one week into a three week trial in the Commercial Court in London).

Tim is particularly experienced in managing large scale electronic disclosure exercises.
