GP acquitted of sexual assault following an allegation by male patient
Surjit Dubb successfully defended a male GP accused of sexual assaulting a male patient at Basildon Crown Court. The GP was charged with 1 count of sexual assault following a consultation he had with the patient. The GP denied the allegation against him.
The CPS made a number of bad character applications before the trial began which were successfully resisted by the Defence. After the complainant and another CPS witness gave evidence at Trial, the CPS offered no further evidence and discontinued the prosecution, following a thorough cross-examination of those witnesses by Defence Counsel, Mr Philip Evans QC of QEB Hollis Whiteman Chambers. The GP was formally acquitted by the Jury.
