Anaesthetist Cleared of Assault

Stephen Hooper successfully defended a Consultant Anaesthetist who was charged with one count of assaulting a patient, and faced a two-day trial at Brighton Magistrates Court. The allegation was that the doctor had inserted a nasogastric tube into the patient’s nose in the knowledge that she had either not consented, or had withdrawn her consent and that in doing so he had assaulted her. After the close of the prosecution case, the defence made an submission that there was no case to answer, the District Judge dismissed the case and the doctor was acquitted.
