Developments in the law governing the procurement of health and social care services present both opportunities and threats to third sector providers. Increasing numbers of contract opportunities are now subject to formal tendering.  Responding to tenders is now a critical part of many third sector organisations’ activities.

An appreciation of procurement law rights and remedies can give a competitive edge in responding to tenders.  Ensuring that you have all the information you are entitled to during the tender process to aid your submission, can increase the chances of a successful outcome. 

We also utilise our experience in managing procurement processes to advise on the completion of pre-qualification questionnaires and tender documents and the implementation of tender strategies to ensure alignment with evaluation methodologies. 

Where bidders are unsuccessful, we advise bidders on the most effective ways to challenge the decisions taken by contracting authorities, where such processes are defective.

We advise on the ability to challenge tender processes that are non-compliant, unfair or lack transparency.  The commercial implications and consequences of any challenge need to be considered and we utilise our experience from all sectors of procurement to analyse each case on its merits.
