• Advising a Nasdaq listed outsourcing business on the employment aspects of a multi-million pound contract to outsource the transactional HR team of an energy sector PLC. This involved working with in house lawyers and contract lead teams on the most effective way of transferring complex teams of professional staff over a two year transition period, advising on consultations, negotiating the contract terms relating to staff transfer, indemnities, warranties and intensive due diligence. The outcome was the deal was signed and more importantly the creative staff transfer arrangements worked in practice.
• Defending a financial services business against one of the first part time worker harassment cases, for an institution that employs well over 50% women, many of them on a part time basis. One of the issues raised was the imposition of training requirements for part-timers in a regulatory environment. One of our team defended the case on a cradle to grave approach, advising on the case, preparing the defence and conducting the advocacy involving extensive witness evidence. The claim was dismissed by the employment tribunal.
• Providing advice to a retail business on a major restructuring exercise involving collective redundancies since the new statutory discipline and grievance procedures. Working extensively with the in-house HR team our approach was to achieve compliance, buy in from affected staff, and to achieve the new business structure on budget and on time, whilst minimising the risk of claims. No claims resulted.
