James has extensive advocacy experience and regularly represents the interests of NHS trusts and individual practitioners’ interests in complicated and high profile inquests, including deaths of patients detained under the Mental Health Act and hospital deaths involving complex medical issues. He frequently appears at Article 2 and jury inquests involving multiple agencies.

His management of cases has included dealing with highly sensitive disclosure issues, substantial document management, and the preparation of witness evidence.

James regularly acts on behalf of healthcare providers in complex cases before the Court of Protection concerning deprivation of liberty and best interests.

James also advises clients on health & safety, environmental and fire safety matters. His experience includes representing organisations and individuals in fatal accident, asbestos, fire safety, work-related transport and other matters. His expertise has resulted in clients often avoiding prosecution, or successful negotiation of a formal caution instead of a prosecution.

James advises on submissions to, and representation at, formal and informal police and HSE interviews under PACE. He regularly liaises with police and regulators during investigations on clients’ behalf, dealing with search and disclosure issues and represents clients in the Magistrates’ Court. He is experienced in coordinating defence strategies where the organisation and individual directors, officers and managers are being investigated/prosecuted.

James also has significant corporate support experience and advices NHS trusts on mergers and acquisitions, including conducting due diligence on the trust’s services and producing clear and user-friendly reports on key issues.
