"Propco" becomes NHS Property Services

Graham Lea, Partner at specialist healthcare legal firm, Hempsons, comments on Andrew Lansley’s announcement today on the formation of NHS Property Services Ltd.

"The announcement today poses a number of questions that we feel need answering in order to provide further clarification to all those involved in the healthcare property market.

These would include firstly - the new organisation is registered at Companies House, does that mean the Government intends to sell it or float on the stock market in the future? And is this the real way the government intends to raise money?

Secondly, how will the management structure exist? Will PCT staff be involved, and if not that means a loss of corporate knowledge which may cause issues going forward. Also, what will the role of LIFT companies be and how will they fit in, will they be playing the leading role as many anticipate?

Lastly, and perhaps most importantly, Mr Lansley talks of disposals, the traditional way the NHS has disposed of redundant property. However, I would question why it would seem more innovative and entrepreneurial options are not being explored, such as joint ventures with the private sector which will not only save money but could also help raise funds and improve the NHS estate.

The government needs to ensure this is not a lost opportunity for the NHS."
